Prosecutors seek to prove archdiocesan conspiracy
With the jury seated and one less defendant, the first case against a church official accused of covering up child sex abuse has moved into the courtroom, as a national audience turns its attention to the scandal in the Philadelphia archdiocese.
The trial for Msgr. William J. Lynn and Fr. James J. Brennan began March 26.
I didn't realise that the third defendant had changed his plea, just before the trial was due to start.
A third defendant, defrocked priest Edward Avery, pleaded guilty March 22 -- four days before the trial began -- to charges of conspiracy and sexual assault of a 10-year-old St. Jerome Parish altar boy during the 1998-99 school year. Avery received a sentence of two-and-a-half to five years in prison.
The unexpected turn led the defense lawyers for Lynn and Brennan to seek a delay in the trial and a new jury, arguing Avery’s guilty plea tainted the jury. Common Pleas Court Judge M. Teresa Sarmina denied the request, but two jurors were dismissed. The panel now includes 12 jurors and six alternates.
Hamilton said Avery’s plea confirms the existence of a conspiracy and also “forces the trial to focus so much more closely on the cover-up.”

WHEN'S J. RIGALI'S TURN? ....... There are extremely important inferences that already can be drawn so far with reasonable assurance from the ongoing Philly criminal child endangerment trial of the cardinals' top personnel chief, Msgr. Lynn. The first is that the pervasive priest sexual abuse cover-up has been a orchestrated worldwide from the top down for decades. The second is that Msgr. Lynn was clearly following the longstanding directives of the Philly cardinals he reported to. Of course, that gives Lynn neither a legal nor a moral defense. The hierarchy's multi-billion dollar mystical smokescreen has already been blown away in a few days of testimony in Philly and there are many months of disclosures yet to be made.
Cardinal Bevilacqua was a bishop in Brooklyn and Pittsburgh before Philly and was a top international Roman trained canon lawyer, as well as a licensed New York attorney. Cardinal Rigali, in charge in Philly for almost a decade before his old colleague, the pope, in effect, removed him a few months ago, had served in Rome with the pope for almost a couple of decades in very senior Vatican positions before serving for almost a decade as the top man in St. Louis and then Philly.
The Philly trial already shows convincingly that the hierarchical orchestral conductor technique applied to the cover-up of priest rapes and other outrages, once learned, was applicable whether one was covering up in Philly, St. Louis, Pittsburgh, Brooklyn, or it appears Rome. The dark Roman cover-up score can be, and likely is, followed by hierarchical conductors worldwide without missing a beat. A truly "catholic" or universal cover-up technique; how pathetic!
Today's Catholic bishops' report from Rigali's former St. Louis protege, NY's slick Cardinal Dolan, confirms a substantial increase in abuse claims last year indicating little has fundamentally changed in the priest child abuse scandal, other than low level officials may now be applying some lawyer approved procedures mainly for cosmetic legal appearances and may be taking similar less important steps.
Of utmost importance, a decade after the Boston abuse explosion, no Catholic bishops are to this day mandated by Rome to report abuse claims promptly to the police or to have truly independent audits of bishops' compliance with the bishops' widely trumpeted child protection protocols. Doublespeak, par excellence.
So it was hardly surprising that Cardinal Rigali got straight "A's" from his "friendly" auditor just months before suspending in March of last year almost two dozen previously undisclosed "problem priests".
Rigali's own Chairwoman of the purportedly "independent" Philly Archdiocese's Child Protection Review Board soon thereafter expressed shock and indignation that she had never been made aware of most, if not all, of the problem priests who were suspended.
To date, Archbishop Chaput, when not busy trying to replace Obama via an absurd and counter-productive "anti-contraception religious crusade", has apparently buried for now the results of the investgation of these problem priests even though more than a year has passed since his high priced and fully staffed law firm began the investigation.
Philly's "Cardinal friendly DA" has so far publicly shown almost no interest in (1) what the investigation of these problem priests has produced, (2) why the investigation results remain apparently buried by Chaput, and (3) whether the investigation results add to the already strong case for fully investigating Cardinal Rigali for endangering children by suppressing the files of these problem priests right up until last year when the scathing 2011 grand jury report forced his hand.
When, and if, Philly's ambitiously plodding DA begins his long overdue investigation of Cardinal Rigali's disturbing misdeeds, he ought to also investigate whether Archbishop Chaput, by apparently burying the problem priest investigation findings, is not himself potentially chargeable with criminally surpressing evidence of possible criminal child endangerment crimes committed by Cardinal Rigali right up until last year. Such endangerment is still well within the existing PA statute of limitations, it would appear.
This is not some insignificant game of "hide the ball". Defenseless children's lives at stake, as well as long overdue justice for at least hundreds of suffering victims still hungering and thirsting for some minimal justice in Philly.

Goodness me, the next thing someone will be suggesting is that Chaput sent it to Rome, shredded the document and deleted the Hard-Disc copy!
