An abuse case in Chile (Main Forum)
Fr. John Reilly is an Irish Legion of Christ priest who came to Chile in 1985. He has made a name for himself as a radio broadcaster.
In 2008, the Chilean Parliament approved a measure to give him Chilean nationality in gratitude for his "apostolic and educational work for youth".
Now he has been accused of sexual abuse of minors, and it is splashed all over the newspapers and radio (I'm in Chile at the moment).
The Archbishop of Santiago, Ricardo Ezzati said that Fr. Reilly was being investigated by the police, and at the same time, he had asked the Superior General of the Legion, to carry out an investigation in accordance with Santorum Sanctitatis Tutela and the decisions of the Chilean Episcopal conference, and that a "canonical investigtion" would be undertaken.
You may recall that Santorum Sanctitatis Tutela of 2001 was the document under which all cases of sexual abuse of minors was to be sent to the CDF, whose head, at that time, was Cardinal Josef Ratzinger. Once the complaint had been sent to the CDF, it would tell the bishop what to do, but anything they did do was subject to "pontifical secrecy".
Now, in 2010, Benedict XVI said, contrary to everything he and the Roman Curia had stood for before, that the Church has to cooperate with civil authorities in cases of sex abuse, and he called upon various countries and dioceses to put forward their proposals. So reporting to police is still not the universal rule, despite exemptions being given to Australia, Britain and the United States to allow them to report.
But "pontifical secrecy" is still part of Santorum Sanctitatis Tutela. So what does that mean? Will the Church hand over its documents that arise out of his own canonical investigation, or, are these still subject to pontifical secrecy?

Good question!
James, is the situation in South America re CSA the same as in other countries?
As most countries there are looked on as 'Catholic', is the first priority to protect the 'good name' of the Church or is there mandatory reporting to the police?
Has there been any investigations done in any of the South American countries?
