I really can't comment on what Frank Brennan should have known. I was more expressing my surprise that even "a learned lawyer" made the admission on television.

My general sense is that most people do not understand how the legal system works. I had very little to do with the law in my life up until the age of about 45 and then, through a series of almost accidents, I became heavily involved with it for a few years – and, at that, only a couple of small parts of it. Even now I am still gobsmacked by my ignorance. My sense still is that the vast majority of citizens in a country like ours would be unaware of their obligations under S.316 of the NSW Crimes Act unless they found themselves under investigation or arrest for some breach of that part of the Act.
